Terms of Service
The contract governing accounts, projects, client links, paid access, templates and use of PhotoStrip Studio.
1. Agreement
These Terms of Service form a contract between you and Oliver Perkins Robb, a sole trader (ABN 19 199 423 833) operating the PhotoStrip Studio service from Victoria, Australia. By creating an account, purchasing a product, downloading a licensed template or using an authenticated feature, you agree to these terms and the policies incorporated into them.
If you use PhotoStrip Studio for a company or other organisation, you confirm that you have authority to bind it. “You” then includes that organisation. If you do not agree, do not create an account or use account-only features.
2. The service
PhotoStrip Studio provides software for photo-strip design, project organisation, client briefs, proposals, comments, approvals, client submissions, brand settings, exports and licensed template resources. Features marked beta, preview, experimental or coming soon may be incomplete, change or be withdrawn.
PhotoStrip Studio does not operate your photo booth, guarantee compatibility with every vendor version or replace your obligation to test exported files in the target booth software before an event.
3. Eligibility and accounts
- You must be at least 18 and legally able to enter a contract.
- Registration information must be accurate and kept current.
- Accounts are for the registered operator and must not be sold, transferred or shared outside the access permitted by your subscription.
- You are responsible for account credentials and all authorised activity. Tell us promptly if access may have been compromised.
- Each operator owns its own account data. Team and organisation access is not included unless we expressly introduce it.
4. Customer responsibilities
- Obtain permission to upload, edit, store, send and display all client data, logos, images, fonts and other content you provide.
- Give clients legally required privacy information and choose an appropriate lawful basis for using their data.
- Check designs, spelling, dimensions, crop, colour, output and booth-software compatibility before production use.
- Keep independent copies of important final exports and source assets.
- Protect shareable links and promptly revoke any link that may have reached an unintended person.
- Follow the Acceptable Use Policy, Template Licence and applicable laws.
5. Your content
You retain ownership of content you or your clients provide. You grant PhotoStrip Studio a worldwide, non-exclusive, royalty-free licence to host, copy, process, resize, render, transmit, display and delete that content only as reasonably necessary to provide, secure, support and improve the service, comply with your instructions and meet legal obligations.
You confirm that your content and our permitted handling of it do not infringe another person’s rights. We do not claim ownership of your completed client designs merely because they were created using the service, subject to our ownership of the software, templates and included assets.
6. PhotoStrip Studio intellectual property
The service, interface, code, branding, documentation, original template systems, graphics and product-owned assets are owned by or licensed to PhotoStrip Studio. Except for the limited rights expressly granted, no intellectual-property rights are transferred to you.
You must not copy the service, extract source code, bypass controls, use our branding without permission or represent that our product is yours. Feedback may be used without restriction or payment, but we will not publicly identify you as its author without permission.
7. Template restrictions
Templates are licensed, not sold. You may use a properly licensed template to create finished photo-booth designs and event outputs for your own business and its clients. You must not resell, redistribute, sublicense, share, upload to another template marketplace, give away or commercially exploit any template, source package or substantially extractable template asset as a template or design resource.
A modified template remains subject to the Template Licence. Changing colours, text, layout, file format or decorative elements does not make the underlying template eligible for resale. Additional plan, seat, download or use limits displayed at purchase also apply.
8. Client links
You may create client links only for legitimate project collaboration. Links may be opened without client authentication. You decide who receives them and what content is exposed. We may apply expiry, revocation, submission, rate or storage limits to protect the service.
9. Paid products and subscriptions
Some features, templates, storage or downloads may later require payment. The price, currency, billing period, included usage, renewal terms and taxes will be shown before purchase. By purchasing, you authorise the stated charge and any clearly disclosed recurring charge.
Subscription cancellation, refunds and access after cancellation are governed by the Billing, Cancellation and Refund Policy. We may change future prices or plan inclusions with reasonable advance notice. A price change will not retrospectively alter a completed one-time purchase.
10. Service changes and availability
We may maintain, improve, replace or discontinue features. We do not promise uninterrupted or error-free availability. Where practical, we will give reasonable notice before a material discontinuation affecting paid customers and provide a reasonable opportunity to export customer-controlled content.
11. Suspension and termination
You may stop using the service and request account deletion. We may limit or suspend access where reasonably necessary for security, non-payment, material breach, unlawful use, risk to others or service integrity. We may terminate for a serious or repeated breach, usually after a reasonable opportunity to remedy it where the breach can be remedied.
On termination, licences to the service end. Clauses that by nature should continue—including payment, ownership, template restrictions, disclaimers, liability, disputes and confidentiality—survive. Lawfully created finished client outputs may continue to be used, but template source files remain subject to their licence.
12. Disclaimers
To the maximum extent permitted by law, the service is provided on an “as available” basis. We do not guarantee a particular commercial result, client approval, vendor certification, colour match, print outcome, uninterrupted availability or preservation of the only copy of a file.
Nothing in these terms excludes a guarantee, warranty, condition, right or remedy that cannot lawfully be excluded, including applicable Australian Consumer Law rights.
13. Liability
To the extent permitted by applicable law, we exclude liability for indirect or consequential loss, loss of profit, lost opportunity, event interruption, lost data or reputational loss arising from the service. Where liability may lawfully be limited, our aggregate liability is limited to the greater of AUD 100 and the fees you paid to PhotoStrip Studio in the 12 months before the event giving rise to the claim.
These limits do not apply to fraud, wilful misconduct, or any liability or remedy that applicable law does not allow us to exclude or limit, including non-excludable consumer protections. You are responsible for losses resulting from content, instructions or use that breaches these terms or another person’s rights.
14. Governing law and disputes
These terms are governed by the laws of Victoria, Australia. Before filing a claim, each party should give the other written details and allow 30 days for a good-faith attempt to resolve it. Courts with jurisdiction in Victoria may hear unresolved disputes, subject to any non-excludable right to bring a claim elsewhere.
15. General
If part of these terms is unenforceable, it will be limited or removed only to the extent necessary and the remainder continues. A delay in enforcement is not a waiver. You may not assign these terms without our consent; we may assign them as part of a genuine restructure, financing or sale of the service. These terms and incorporated policies are the agreement about the service unless separate written terms apply.
We may update these terms for legal, security, operational or product reasons. We will post the revised date and give reasonable notice of material changes affecting paid or continuing use. Contact hello@photostripstudio.com with questions.
